1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Kappataf, operated by Konstantinos Tsaldaris ("Kappataf," "we," "us," "our," or "Company"). By accessing, browsing, and using the website aikappataf.com ("Site") and engaging with our services, including 3D Archviz, Motion & Ads, UE5 Projects, Digital Twins, Digital Casting with AI Actors, Narrative Architecture & World-Building, and Tactical Combat Advisor for Cinema and Epic Storytelling, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site or our services.
 

2. Use License

Kappataf grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site and its Content solely for your personal, non-commercial purposes, or for legitimate business inquiries related to our services. This license does not include:

The right to modify or alter the Site or any Content

The right to copy, reproduce, or distribute Content without explicit written permission

The right to use the Site for commercial purposes or competitive endeavors

The right to remove or obscure any proprietary notices or labels

3. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to:

  • Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us

  • Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses

  • Use a buying agent or purchasing agent to make purchases on the Site

  • Use the Site to advertise or offer to sell goods and services

  • Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein

  • Engage in unauthorized framing of or linking to the Site

  • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords

  • Make improper use of our support services or submit false reports of abuse or misconduct

  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools

  • Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site

  • Attempt to impersonate another user or person or use the user name of another user

  • Sell or otherwise transfer your profile

  • Use any information obtained from the Site in order to harass, abuse, or harm another person

  • Use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise

  • Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site

  • Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site

  • Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you

  • Delete the copyright or other proprietary rights notice from any Content

  • Copy or adapt the Site's software, including but not limited to Flash, PHP, HTML, JavaScript, or other code

  • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site

  • Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms")

  • Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software

  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site

  • Use the Site in a manner inconsistent with any applicable laws or regulations

4. Intellectual Property Rights

4.1 Ownership of Site Content

All content on the Site, including but not limited to text, graphics, logos, images, audio clips, video clips, digital downloads, data compilations, software, source code, designs, and all other materials ("Site Content"), is the exclusive property of Kappataf and is protected by international copyright, trademark, patent, and other intellectual property laws. This includes all portfolio items, case studies, and project examples showcasing our work in 3D Archviz, Motion & Ads, UE5 Projects, Digital Twins, Digital Casting with AI Actors, Narrative Architecture, and Tactical Combat Advisor services.

4.2 Client Work & Deliverables

When you commission services from Kappataf (including 3D Archviz, Motion & Ads, UE5 Projects, Digital Twins, or Digital Casting projects), the following intellectual property terms apply:

4.2.1 Work Product Ownership

Upon full payment of project fees, Kappataf grants you a non-exclusive license to use the final deliverables ("Work Product") for the agreed-upon purposes. The Work Product includes all final renders, animations, digital assets, and other completed materials as specified in your project agreement.

4.2.2 Creator Intellectual Property

Kappataf retains ownership of all underlying methodologies, processes, techniques, templates, pre-built 3D models, plugin libraries, AI models for digital casting, and other tools used in creating your Work Product. You may not reverse engineer, decompile, extract, or reuse these elements for competing projects without written consent.

4.2.3 Portfolio Usage

Kappataf reserves the right to display the Work Product (or anonymized versions thereof) in our portfolio, case studies, website, and marketing materials unless you explicitly request confidentiality in writing. Confidential projects will not be publicly showcased without your written permission.

4.2.4 License Scope

Your license to use the Work Product is limited to the specific scope defined in your project agreement. Commercial use beyond this scope requires additional licensing fees. Resale, redistribution, or sub-licensing of the Work Product without explicit written permission is prohibited.

4.3 Trademark & Branding

"Kappataf" and associated logos, icons, and branding elements are trademarks of Kappataf, operated by Konstantinos Tsaldaris. You may not use these marks without prior written consent. Unauthorized use of our trademarks or branding may result in legal action.

4.4 Digital Assets & AI Models

For Digital Casting projects involving AI-generated actors and personas:

  • AI models and synthetic characters are proprietary to Kappataf unless otherwise agreed

  • Your license covers use of the final rendered content for the agreed-upon project

  • You may not use AI models or characters created for your project for third-party commercial purposes

  • Kappataf retains the right to improve, update, or modify AI models for future client projects

4.5 UE5 & 3D Assets

For Unreal Engine 5 projects:

  • Custom 3D models and environments created for your project are licensed to you for the specified use

  • You may not redistribute, sell, or share custom assets with third parties

  • Epic Games' UE5 Terms of Service also apply to your use of UE5-based deliverables

  • Commercial projects may require additional licensing fees

4.6 Narrative Architecture & Tactical Combat Advisor Work

For services involving Narrative Architecture, world-building, plot design, story concepts, and Tactical Combat Advisor expertise for cinema and epic storytelling:

4.6.1 Narrative Development & Ownership

All original narrative architectures, world-building concepts, plot structures, character designs, story bibles, and thematic frameworks created by Konstantinos Tsaldaris are the exclusive intellectual property of Kappataf. This includes:

  • Narratives created entirely by Konstantinos Tsaldaris based on his original creative vision

  • Narratives developed by Konstantinos Tsaldaris from a client's general concept or premise (client provides initial idea/zoom; Kappataf develops the full narrative structure)

In both cases, the Client receives a non-exclusive, non-transferable license to use the completed narrative work solely for the agreed-upon production project. The underlying intellectual property, methodologies, and narrative architecture remain the exclusive property of Kappataf.

4.6.2 Creative Development Rights

  • If you provide an initial story concept, idea, or premise: Kappataf retains ownership of all creative development, expansion, and refinement of that concept into a full narrative

  • Kappataf's creative work in developing your concept into a complete story, world, characters, and plot is proprietary to Kappataf

  • You may not engage another creator to further develop or expand this narrative without Kappataf's written consent

4.6.3 Scripts & Story Documentation

All scripts, treatments, outlines, character breakdowns, scene descriptions, dialogue, and narrative documentation created during the project are licensed to you for production purposes only. These documents may not be modified, redistributed, or used for competing projects.

4.6.4 Combat Design & Choreography

Tactical combat sequences, fight choreography notes, battle strategies, combat system designs, and tactical narratives created for your project cannot be resold, licensed, or shared with competing productions. These are project-specific deliverables.

4.6.5 Methodology & Framework

Konstantinos Tsaldaris' narrative frameworks, world-building methodologies, character development processes, and tactical design systems remain the exclusive intellectual property of Kappataf. These are proprietary tools used in creating your work and may be applied to future projects with other clients.

4.6.6 Derivative Works & Extensions

You may not create, commission, or authorize sequels, prequels, spin-offs, expanded universes, derivative works, or any narrative extensions based on the story world and concepts created for your project without explicit written permission from Kappataf and additional licensing fees.

4.6.7 Attribution & Credits

Kappataf reserves the right to receive screen credit, production credits, and public recognition for narrative architecture, world-building, story conception, and tactical combat advisor services provided. This includes credit in marketing materials, IMDb, and official production documentation.

4.6.8 Portfolio & Showcase Rights

Kappataf reserves the right to showcase the narrative work, story concepts, and combat designs in portfolio, case studies, industry presentations, and educational materials (unless explicitly confidential). This helps establish Konstantinos Tsaldaris' reputation as a narrative architect and combat advisor.

4.7 Infringement Claims

If anyone claims that the Work Product infringes their intellectual property rights, and this claim arises from your requested modifications or specifications (not from Kappataf's standard methodologies), you agree to indemnify and hold Kappataf harmless from any damages, legal fees, or liabilities resulting from such claims.

5. Security & Data Protection Measures

Kappataf takes data security and client confidentiality with utmost seriousness. We have implemented comprehensive security measures to protect your information and project files:

5.1 Encryption & Transmission Security

  • All data transmitted between your device and our servers is encrypted using industry-standard TLS 1.2+ protocol (HTTPS)

  • Project files are encrypted both in transit and at rest using AES-256 encryption

  • Sensitive information (passwords, payment details) is encrypted and never stored in plain text

5.2 Access Control & Authentication

  • All access to project data requires strong authentication (multi-factor authentication available for client accounts)

  • Only authorized team members with need-to-know access can view your project files

  • Role-based access controls ensure employees only access data necessary for their functions

  • All staff sign strict confidentiality agreements

5.3 Infrastructure Security

  • Hosting through secure, industry-certified cloud providers (ISO 27001 compliant)

  • Enterprise-grade firewalls and intrusion detection systems

  • Regular security patches and software updates

  • DDoS protection and WAF (Web Application Firewall) enabled

  • Redundant backup systems with geographically distributed data centers

5.4 File Transfer & Storage

  • Project files are transferred via secure, password-protected channels

  • We use encrypted file transfer protocols (SFTP, secure cloud links with expiration dates)

  • Large files are virus-scanned before and after transfer

  • Temporary project files are automatically deleted after retention periods

  • You can request permanent deletion of your data at any time (within legal compliance periods)

5.5 Monitoring & Incident Response

  • Continuous security monitoring and log analysis for suspicious activities

  • Incident response plan in place with 24-hour notification requirement if breach occurs

  • Regular security audits and vulnerability assessments

  • Third-party security testing and penetration tests performed annually

5.6 Advanced Communication Security & Dark Web Monitoring

For handling sensitive and confidential client project files, Kappataf employs advanced security practices:

  • End-to-End Encrypted Communications: We use ProtonMail's end-to-end encryption technology for all sensitive email communications and video meetings. This ensures that only the intended recipient can decrypt and read your messages, even if intercepted. Our communications channel is protected at the highest cryptographic standard.

  • Dark Web Monitoring: Actively monitoring the dark web and underground forums for any evidence of compromised credentials, leaked project files, or stolen intellectual property. If any of your data is detected on the dark web, we will immediately notify you so you can take protective measures.

  • Breach Detection Services: We subscribe to advanced threat intelligence services that alert us to potential security breaches involving your data across known breach databases.

  • Credential Monitoring: All staff credentials and authentication systems are monitored for suspicious activity or compromise attempts.

5.7 Confidentiality & NDA

Kappataf operates under strict confidentiality agreements:

  • All client information and project details are treated as confidential

  • We will not disclose your information to third parties without written consent (except as legally required)

  • Formal NDA agreements available upon request for high-security projects

  • Trade secrets and proprietary methodologies are protected

5.8 Compliance Standards

Kappataf complies with:

  • GDPR (General Data Protection Regulation) - Full compliance with EU data protection requirements

  • ISO 27001 - Information Security Management System standards

  • HIPAA-like practices for sensitive client information (where applicable)

  • OWASP Top 10 - Web application security best practices

6. User Responsibilities for Security

While Kappataf maintains strong security measures, you are responsible for:

  • Maintaining the confidentiality of your account credentials and passwords

  • Notifying us immediately of any unauthorized access or security breach

  • Using strong, unique passwords and changing them regularly

  • Not sharing your login credentials with third parties

  • Ensuring your devices have updated security software and firewalls

  • Not transmitting sensitive information through unsecured networks

7. Disclaimer of Warranties

THE SITE AND ALL SITE CONTENT, INCLUDING SERVICES, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, KAPPATAF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Title

  • Accuracy or completeness of content

  • Uninterrupted or error-free service

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KAPPATAF, ITS OWNERS, OPERATORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF KAPPATAF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

Our total liability to you for any claim arising from or relating to the Site or these Terms shall not exceed the amount you paid to Kappataf in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kappataf and its owners, operators, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from or relating to:

 

  • Your violation of these Terms

  • Your violation of any applicable laws or regulations

  • Your use of the Site or services

  • Your infringement of third-party intellectual property rights

  • Content you provide or generate

10. Payment & Refund Policy

Payment terms for services are specified in individual project agreements. A 50% deposit is typically required to begin work, with the balance due upon project completion. Refunds are provided only if Kappataf fails to deliver the agreed-upon Work Product. Custom projects are non-refundable after work has commenced unless the Work Product is deemed unacceptable due to Kappataf's negligence.

11. Termination of Service

Kappataf reserves the right to terminate or suspend your access to the Site or services at any time, for any reason, with or without notice, including for:

  • Violation of these Terms
